Mr. Ly is currently cultivating all three parcels, primarily growing rice, and earning a stable income from rice cultivation. During the cultivation process, he hires local laborers (paid on a daily basis) to perform various tasks such as land preparation, rice sowing, fertilization, pesticide spraying, and harvesting. This is because the area where he resides has already mechanized these production stages.

Mr. Ly is wondering whether he will receive support for occupational conversion and job searching when the government reclaims two of his parcels for the transportation project.

The Ministry of Natural Resources and Environment provides the following response to this issue:

Regarding Mr. Ly's specific case, as there are no accompanying documents, the Department of Planning and Land Development does not have the basis to provide a specific answer.

The current land legislation stipulates the specific provisions for supporting occupational conversion and job searching when the state reclaims agricultural land from households and individuals directly engaged in agricultural production. These provisions are specified in Point b, Clause 2, Article 83, and Article 84 of the Land Law 2013; Article 20 of Decree No. 47/2014/ND-CP dated May 15, 2014, by the Government, which regulates compensation, support, and resettlement when the state reclaims land (supplemented in Clause 6, Article 4 of Decree No. 01/2017/ND-CP dated January 6, 2017, by the Government, amending and supplementing certain decrees detailing the implementation of the Land Law).

It is recommended that Mr. Ly study the aforementioned legal provisions and contact the Can Tho Department of Natural Resources and Environment to have his case considered and resolved in accordance with the provisions of the law.
